A1. Introduction

The Nunavut Surface Rights Tribunal ("NSRT" or "Tribunal") is established pursuant to the Nunavut Waters and Nunavut Surface Rights Tribunal Act and the Nunavut Land Claims Agreement, as adopted by the Nunavut Land Claim Act. The NSRT is established for the purpose of providing an independent mechanism for the resolution of disputes arising from:

  1. Access to surface land in Nunavut;
  2. Claims for compensation arising from loss or damage to wildlife, carving stone and other specified substances from development in Nunavut.

The Nunavut Waters and Nunavut Surface Rights Tribunal Act provides that the NSRT is an Institution of Public Government but is not an agent of the Government of Canada.

The Access to Information Act and Privacy Act establish that the NSRT is accountable for reporting annually on the administration of both Acts.

The purpose of the Access to Information Act (1985) is to:

"extend the present laws of Canada to provide a right of access to information in records under the control of a government institution in accordance with the principles that government information should be available to the public, that necessary exceptions to the right of access should be limited and specific and that decisions on the disclosure of government information should be reviewed independently of government."

The Tribunal submits this report in accordance with Section 72 of the Act. Section 72 requires that an annual report on the administration of the Act within the financial year be submitted and tabled in Parliament and then be referred to the committee designated for the Act.

A2. Organizational Structure

The Act provides for 3 to 11 members, including the Chair appointed by the Minister of Indigenous Affairs and Northern Development. At least two members must be resident in the Nunavut Settlement Area.

A3. Delegation Order

The head of the institution did not delegate any of their powers and responsibilities under the Act.

A4. Highlights of the Statistical Report, 2019-2020

There were no Access to Information requests for this fiscal year 2019-2020. As requested, the completed Statistical Report for 2019-2020 is attached.
