Section D: Anticipated activities related to basic funding
- While there is now more flexibility for funding to be reallocated between basic funding costs, the First Nation is to inform the Negotiation Support Directorate as soon as possible of any major changes to the anticipated activities set out in the approved work plan which may affect the budget requirement and payment schedule
- Maximum basic funding (for First Nation costs, legal costs, professional costs and other costs) for a claim is $200,000 per year, including a maximum of $100,000 for legal costs.
- Studies and reports are not part of basic funding
- Ratification costs are also not part of basic funding
- First Nations should be cautious in assuming large loans in small value claims; the amount of negotiation costs included in a final settlement offer will not exceed the compensation amount except in extraordinary circumstances
Meetings
Face-to-face negotiations
- Indicate the number of meetings, the number of days per meeting, and the total number of days for all face-to-face negotiations (including preparation and follow up)
- List dates of meetings if known, or anticipated month of meetings, anticipated participants and location of meetings
- A typical claim has a maximum of 3 to 4 in person meetings each year
- The budget submission can include time for preparation for meetings and for follow up from meetings
Negotiation conference calls
- Indicate the number of meetings, and the total number of days for all negotiation conference calls (including preparation and follow up)
- List dates of meetings if known, or anticipated month of meetings and anticipated participants
- A typical claim has a maximum of 3 to 4 conference calls each year

First Nation community meetings

Legal work
Provide a description of the legal work to be accomplished and the number of hours required to complete the work identified.
For example:

- provide legal advice regarding the negotiation process (number of hours)
- participate in negotiation sessions as warranted (number of hours)
- finalize legal agreements (number of hours)
Consultants, experts and professional costs
The First Nation must list any professional services, other than to conduct studies and reports, that will be required, such as consultants and contractors. Include a description of the work to be accomplished by each consultant or contractor and the number of hours required to complete the work identified.
Other costs
First Nation is to itemize any other costs anticipated during the fiscal year such as administration fees, technical or advisory committees, other meeting costs and communications.
Section E: Studies and reports
Joint studies
- All studies and reports must be jointly approved
- If available, submit terms of reference and contract details (loan funding cannot be released without knowing the amount of the contract)
- If not yet available, indicate in this section the anticipated studies for the year, including the purpose of the study and the level of effort (a range of the number of days of work) anticipated to assist in prediction for budget management purposes
- Terms of reference and contract details can be submitted during the fiscal year for studies and reports but must be received before February 1 to be considered, subject to budget availability, for additional funding
Independent studies
- All studies and reports must be jointly approved
- As studies are meant to be joint in a negotiation process, the exceptional rationale for an independent study must be clearly stated (reminder that negotiation loan funding cannot be used to fund litigation or tribunal related activities)
- If there are any independent studies, the approval of the Senior Director of Negotiation, Specific Claims Branch, will be required
- If available, submit terms of reference and contract details (loan funding cannot be released without knowing the amount of the contract)
- If not yet available, indicate in this section the anticipated studies for the year, including the purpose of the study and the level of effort (such as a range of the number of days of work) anticipated to assist in prediction for budget management purposes
- A maximum cumulative amount of $50,000 annually can be provided towards the eligible costs to support approved independent studies and reports
- Annual terms of reference and service provider's statement of work or contract information are to be provided to support the funding request for these independent studies and reports
- Terms of reference and contract details can be submitted during the fiscal year for studies and reports but must be received before February 1 to be considered, subject to budget availability, for additional funding
Section F: Ratification activities
- List all ratification activities (for example, hall rental, ratification officer honorarium and mail-outs)
- Ratification funding is based on a formula of $37,500 or $25 per voting member, whichever is higher; indicate number of voting members if relevant
- The formula will be reduced if Canada conducts part of the ratification activities, such as a vote under the Indian Act Referendum Regulations
Section G: Work plan submission
To complete this section, please fill out the required fields with the full name of the First Nation. The application must be signed and dated by the Chief of the First Nation. For any independent studies or exemptions to any part of the guidelines, the application must be approved by both the negotiator and senior director of negotiations, Specific Claims Branch.

- It is understood that costs will be assessed against the Specific claims negotiation cost guidelines and the total maximum annual allocation indicated in the guidelines. Annual amount of funding to a funding recipient will be determined based on a jointly approved work plan, availability of loan funding and the funding recipient budget describing the activities, deliverables and reasonable costs to support the negotiation of the claim
- It is understood that there is no guarantee that the maximum annual allocation will be provided, nor that funding will be provided for all approved activities
- It is understood that any reporting requirement not submitted in accordance with previous years loan agreements, where applicable, may impact on future loan funding offer and payments
- It is understood that the Negotiation Support Directorate is not responsible for:
- any expenditure incurred by the Fist Nation prior to a promissory note and loan funding agreement being signed
- any deficit incurred by the First Nation spending over the amounts identified as eligible expenditures in the signed loan agreement for the fiscal year
